
Rubbish Removal Croydon Service Terms and Conditions
These Terms and Conditions set out the basis on which Rubbish Removal Croydon provides rubbish removal, waste collection and related services to residential and commercial customers in Croydon and the surrounding area. By booking a service, you agree to be bound by these Terms and Conditions. Please read them carefully before placing an order.
1. Definitions
In these Terms and Conditions, the following expressions have the meanings given below:
Customer means any individual, business, company or organisation that requests or receives services from Rubbish Removal Croydon.
Services means any rubbish removal, waste collection, clearance, loading, transport, disposal, recycling or related services provided by Rubbish Removal Croydon.
Waste means any items, materials, rubbish, junk, refuse or other matter to be removed or collected as part of the Services.
Booking means a confirmed request for Services that has been accepted by Rubbish Removal Croydon, whether made by telephone, email, website form or other agreed method.
Vehicle means any vehicle operated or arranged by Rubbish Removal Croydon in connection with the Services.
2. Scope of Services
Rubbish Removal Croydon provides waste collection and rubbish removal services for domestic and commercial premises. Services may include single item collection, full or part property clearance, garden waste clearance, office and shop waste removal, and ad hoc or scheduled collections of general non-hazardous waste.
The specific nature and extent of the Services to be provided on each occasion will be agreed at the time of Booking, based on the information supplied by the Customer. Rubbish Removal Croydon reserves the right to refuse any waste or items that fall outside the agreed scope, or which cannot lawfully or safely be removed or transported.
3. Booking Process
Customers may request a quote and make a Booking by telephone, email or through an online enquiry form where available. When making a Booking, the Customer must provide accurate and complete information about the type and estimated volume of waste, the collection address, access details, parking arrangements, and any other relevant information that may affect the provision of the Services.
Quotes are based on the information provided at the time of enquiry. If, upon arrival, the quantity, type or location of the waste differs significantly from that described, Rubbish Removal Croydon may adjust the price, amend the scope of work or decline to carry out part or all of the Services.
A Booking is only confirmed when Rubbish Removal Croydon has accepted the request and provided a time window or appointment date. Rubbish Removal Croydon will make reasonable efforts to arrive within the agreed time window but cannot guarantee precise arrival times. Time is not of the essence for the performance of the Services.
4. Access, Parking and Customer Obligations
The Customer must ensure that suitable access is available for the Vehicle and crew at the agreed collection time. This includes arranging any necessary parking permissions or permits and ensuring that driveways, entrances, corridors, lifts and stairways are reasonably clear and safe for use by the crew.
Where parking charges apply, unless expressly agreed otherwise, such charges will be added to the Customer’s invoice. If the Vehicle cannot be parked within a reasonable distance of the collection point due to restrictions or lack of space, Rubbish Removal Croydon may either adjust the price to reflect the additional labour or time required or decline to proceed with the Services and treat the visit as a cancelled Booking.
The Customer is responsible for ensuring that all Waste to be removed is clearly identified and accessible. The crew will not be responsible for removing items that are not clearly designated as Waste, or for any items left behind as a result of unclear instructions. The Customer should be present during the collection or must provide clear written or verbal authority and instructions if someone else is to oversee the collection.
5. Pricing and Payments
Prices for the Services will be quoted based on factors such as the estimated volume of waste, its type and weight, access conditions, loading time, and any additional services requested. Unless otherwise stated, all prices are exclusive of any applicable taxes, which will be added at the prevailing rate.
Rubbish Removal Croydon reserves the right to revise its standard prices at any time. However, once a Booking has been confirmed, the price applicable to that Booking will not be altered, except where the actual waste or conditions differ from those described by the Customer at the time of Booking.
Payment is normally due on completion of the Services, unless alternative arrangements have been agreed in writing in advance, for example for account customers. Payment may be made by cash, debit or credit card or other accepted methods. Rubbish Removal Croydon reserves the right to require full or partial payment in advance for certain Bookings, particularly for large clearances or where special arrangements are required.
If the Customer fails to make payment when due, Rubbish Removal Croydon may charge interest on the overdue amount at the statutory rate, together with any reasonable costs incurred in recovering the debt. Ownership of any items removed does not pass to the Customer; the Customer is paying for the provision of waste collection and disposal Services only.
6. Cancellations, Amendments and Waiting Time
The Customer may cancel or amend a Booking by giving at least 24 hours notice prior to the scheduled arrival time. Where the Customer provides sufficient notice, no cancellation charge will normally apply. If the Customer cancels or materially changes the Booking with less than 24 hours notice, Rubbish Removal Croydon reserves the right to charge a reasonable cancellation fee to cover administration and scheduling costs.
If the crew attends the collection address at the agreed time but is unable to carry out the Services due to circumstances within the Customer’s control, including but not limited to lack of access, unsuitable parking, or the Customer’s failure to attend when required, this may be treated as a late cancellation and a call-out fee may be charged.
Where the crew is kept waiting for reasons beyond the control of Rubbish Removal Croydon, waiting time may be charged at the applicable hourly or part-hourly rate after a reasonable initial waiting period. Any additional charges will be communicated to the Customer wherever feasible before they are incurred.
7. Waste Types and Prohibited Items
Rubbish Removal Croydon normally collects general non-hazardous waste, such as household rubbish, bulky items, furniture, appliances, garden waste, office waste and similar materials. The Customer must inform Rubbish Removal Croydon in advance if the Waste includes any items that are particularly heavy, difficult to handle, or require special disposal arrangements.
Certain items cannot be collected as part of standard Services, including but not limited to asbestos, clinical or medical waste, chemicals, solvents, oils, fuel, gas bottles, explosives, paint cans with liquid content, and any other hazardous or regulated materials. If such items are discovered at the time of collection, Rubbish Removal Croydon may refuse to remove them and may charge for any time already spent on site.
Electrical and electronic equipment, fridges, freezers, mattresses and other specific items may incur additional disposal charges due to recycling or treatment requirements. Any such charges will be explained to the Customer as part of the quotation where known in advance.
8. Compliance with Waste Regulations
Rubbish Removal Croydon operates in accordance with relevant UK waste legislation and regulations. All Waste collected will be transported to authorised disposal or recycling facilities, and the company will take reasonable steps to maximise recycling where practical and economically viable.
Where legally required, a waste transfer note or other documentation will be completed and retained. By using the Services, the Customer confirms that they are the lawful holder of the Waste and that they have the authority to arrange for its removal and disposal.
The Customer must not request the crew to engage in fly-tipping or any unlawful disposal or handling of Waste. Rubbish Removal Croydon will not be responsible for any liability arising from the Customer’s failure to comply with their own legal obligations concerning controlled waste, including any duty of care responsibilities.
9. Liability and Limitations
Rubbish Removal Croydon will exercise reasonable care and skill in providing the Services. However, the company shall not be liable for any loss or damage arising from inaccurate information provided by the Customer, lack of access, unsafe conditions, or the presence of hazardous materials not disclosed in advance.
While all reasonable care will be taken when removing Waste from the Customer’s premises, minor cosmetic damage, such as scuffs or marks to walls or flooring, may occur in confined spaces or when moving bulky items. The Customer acknowledges this risk and agrees that Rubbish Removal Croydon shall not be liable for such minor damage, provided reasonable care has been exercised.
Rubbish Removal Croydon will not be liable for any indirect or consequential loss, including loss of profit, loss of business, or loss of opportunity, arising out of or in connection with the Services. In any event, the total liability of Rubbish Removal Croydon for any claim arising under or in connection with a Booking shall be limited to the total price paid or payable for the Services under that Booking.
Nothing in these Terms and Conditions limits or excludes liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot lawfully be limited or excluded under applicable law.
10. Customer Property and Title to Waste
Once Waste has been loaded onto the Vehicle, it will not normally be possible to retrieve individual items. The Customer must ensure that no items intended to be retained are mixed with the Waste. Rubbish Removal Croydon accepts no responsibility for items removed in error where they could not reasonably be distinguished from the Waste.
Upon loading onto the Vehicle and acceptance for removal, title to the Waste transfers to Rubbish Removal Croydon or its authorised contractors for the purpose of lawful disposal or recycling, subject to all applicable laws and regulations.
11. Events Beyond Our Control
Rubbish Removal Croydon shall not be in breach of these Terms and Conditions or otherwise liable for any delay in performing, or failure to perform, any of its obligations where such delay or failure results from events, circumstances or causes beyond its reasonable control. This may include severe weather, traffic incidents, vehicle breakdowns, accidents, industrial disputes, regulatory actions or other unforeseen events.
Where a delay occurs, Rubbish Removal Croydon will make reasonable efforts to inform the Customer and to reschedule the Services as soon as reasonably practical. In such circumstances, no compensation will be payable for inconvenience or delay.
12. Complaints and Dispute Resolution
If the Customer is dissatisfied with any aspect of the Services, they should raise the issue as soon as possible, ideally while the crew is still on site, so that any concerns can be addressed immediately. Complaints may also be made by telephone or in writing after the event. Rubbish Removal Croydon will investigate all complaints promptly and aim to resolve them fairly.
If a dispute cannot be resolved directly, the parties may consider using mediation or another form of alternative dispute resolution before resorting to court proceedings, although this is not mandatory.
13. Variations to Terms
Rubbish Removal Croydon may update or amend these Terms and Conditions from time to time to reflect changes in the law, regulatory guidance or business practices. Any revised Terms and Conditions will apply to Bookings made after the date of publication. For ongoing arrangements with account customers, reasonable notice of changes will be given where practicable.
14. Governing Law and Jurisdiction
These Terms and Conditions, and any dispute or claim arising out of or in connection with them or their subject matter or formation, shall be governed by and construed in accordance with the law of England and Wales.
The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the Services, including any non-contractual disputes or claims.
15. Severability
If any provision or part-provision of these Terms and Conditions is or becomes invalid, illegal or unenforceable, it shall be deemed modified to the minimum extent necessary to make it valid, legal and enforceable. If such modification is not possible, the relevant provision or part-provision shall be deemed deleted. Any such modification or deletion shall not affect the validity and enforceability of the rest of the Terms and Conditions.
16. Entire Agreement
These Terms and Conditions, together with any written quotation or confirmation issued by Rubbish Removal Croydon, constitute the entire agreement between the parties in relation to the Services and supersede any prior agreements, understandings or arrangements, whether written or oral. The Customer acknowledges that they have not relied on any statement, promise or representation not set out in these Terms and Conditions when entering into a Booking for Services.
